1. Agreement to Terms

Welcome to My Shop Agent. These Terms of Service ("Terms") govern your use of our AI-powered WhatsApp ordering agent service ("Service"). By accessing or using My Shop Agent, you agree to be bound by these Terms.

2. Description of Service

My Shop Agent is an AI-powered WhatsApp agent that enables:

• Browsing and ordering products from clothing stores via WhatsApp
• Automated order processing and confirmation
• Real-time inventory checking and product information
• Order status tracking and customer support
• Payment confirmation via screenshot uploads

The Service acts as an intermediary between customers and registered clothing stores ("Store Partners").

3. Eligibility

To use My Shop Agent, you must:

• Be at least 13 years of age (or 18 for placing orders)
• Have a valid WhatsApp account
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete information
• Not be prohibited from using the Service under applicable laws

4. User Responsibilities

When using our Service, you agree to:

• Provide Accurate Information: Ensure all order details, delivery addresses, and contact information are correct
• Use Respectfully: Communicate appropriately and not abuse, harass, or misuse the Service
• Verify Orders: Confirm order details before final submission
• Make Timely Payments: Complete payments as agreed with Store Partners
• Accept Deliveries: Be available to receive ordered products

5. Orders and Transactions

5.1 Order Placement

• Orders are placed through WhatsApp conversations with our AI agent
• All orders are subject to product availability and store confirmation
• Order confirmation is sent via WhatsApp message

5.2 Pricing

• Prices are set by Store Partners and may change without notice
• Prices shown are in local currency unless otherwise specified
• My Shop Agent is not responsible for pricing errors by Store Partners

5.3 Payments

• Payment methods are determined by individual Store Partners
• Payment confirmation may be required via screenshot upload
• Cash on Delivery (COD) availability depends on Store Partner policies

6. Cancellations and Returns

Cancellation and return policies are determined by individual Store Partners:

• Contact the store directly through My Shop Agent for cancellation requests
• Cancellations may be subject to fees depending on order status
• Returns and refunds are handled according to Store Partner policies
• My Shop Agent facilitates communication but does not process refunds directly

7. AI Service Limitations

Our AI agent, while advanced, has certain limitations:

• Responses are automated and may occasionally be inaccurate
• Complex queries may require human intervention
• Image recognition (for payment screenshots, etc.) may have errors
• Service availability depends on WhatsApp and third-party systems

8. Intellectual Property

All content, features, and functionality of My Shop Agent, including but not limited to:

• Software, algorithms, and AI models
• Logos, trademarks, and branding
• User interface design and layout
• Documentation and marketing materials

are owned by My Shop Agent and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

To the maximum extent permitted by law:

• Service "As Is": My Shop Agent is provided without warranties of any kind
• Third-Party Products: We do not guarantee the quality, safety, or legality of products sold by Store Partners
• Availability: We do not guarantee uninterrupted or error-free service
• Accuracy: We do not guarantee the accuracy of product information provided by stores

11. Limitation of Liability

To the maximum extent permitted by applicable law, My Shop Agent shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from Store Partner products or services
• Issues caused by third-party services (WhatsApp, payment providers, etc.)

Our total liability shall not exceed the amount you paid for orders in the past 12 months.

12. Indemnification

You agree to indemnify and hold harmless My Shop Agent, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any fraudulent or illegal activities

13. Termination

We may suspend or terminate your access to My Shop Agent:

• For violation of these Terms
• For fraudulent or abusive behavior
• At our discretion with or without notice
• Upon your request to delete your account

Upon termination, your right to use the Service will cease immediately.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Karachi, Pakistan.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Shop Agent regarding the use of our Service, superseding any prior agreements.
